KUALA LUMPUR, 17 June 2009: The High Court here today fixed 30 July to hear Umno’s application to set aside the RM218 million civil suit filed against it by an election merchandise supplier.
Deputy Registrar Aziati Jaafar fixed the case in chambers when it came up for mention. The application will be heard before Justice Datuk Azhar Mohamed.
Elegant Advisory Sdn Bhd filed the civil suit on 23 June 2008, naming Umno treasurer Datuk Seri Abdul Azim Mohd Zabidi as defendant.
In its writ of summons, the company said it was involved in supplying election merchandise, transport service and publications, and had supplied Umno with the items for the 11th general election in 2004 upon the request of Abdul Azim.
It claimed that since Abdul Azim had requested for supply in large quantities and within a short period of time, this resulted in the company appointing third parties (printing companies and other suppliers) to deliver the items on time, and Abdul Azim had full knowledge of this.
The company said it had sent invoices for a sum of RM218,013,475 to Abdul Azim for payment, but the defendant had failed to pay.
On 17 July 2008, Abdul Azim was ordered by the High Court to pay Elegant Advisory RM218 million, interest and costs, after he failed to respond to the suit.
On 21 Jan 2009, Umno succeeded in setting aside the judgment in default.
Elegant Advisory was represented by counsel Nazruddin Abdullah, while Datuk Hafarizam Harun acted for Abdul Azim. — Bernama
