IPOH, 6 Feb 2009: Even as Barisan Nasional (BN)’s candidate for Perak menteri besar, Datuk Dr Zambry Abd Kadir is to be sworn in this afternoon, Pakatan Rakyat says it will resist BN’s takeover “every step of the way until the end”.
Parti Keadilan Rakyat information chief Tian Chua said the Pakatan Rakyat state government plans to convene an emergency sitting of the state assembly to hold a motion of no-confidence against the new menteri besar.
This is expected to take place next week.
Chua said Pakatan Rakyat could still do this as “the Speaker of the house is still ours”, referring to V Sivakumar.
He said it did not matter if the BN now had three independents on its side, bringing its support in the assembly to 31 against Pakatan Rakyat’s 28 seats.
“It is Pakatan Rakyat’s right to convene an emergency assembly and we will keep on doing whatever the law allows us to do every step of the way and we’ll watch BN act ‘ultra vires’ at every turn,” he told The Nut Graph last night at Pakatan Rakyat’s rally at the menteri besar’s official residence.
Chua argued that legally, Datuk Seri Mohd Nizar Jamaluddin could not be dismissed as menteri besar as the state constitution did not provide for it.
However, several legal experts have said that Sultan Azlan Shah acted constitutionally and it would be hard for Pakatan Rakyat to insist n remaining in power.
Nizar has said he refuses to resign, and has appealed to Sultan Azlan Shah to let support for the menteri besar be decided in the state assembly as provided by law.
This follows the ruler’s decision yesterday not to dissolve the assembly and allow fresh elections.
It remains to be seen how quickly BN will move to elect their speaker for the legislative assembly to seal their control of the house.
The BN executive councillors are also expected to be sworn in next week.

Since the positions of the three frogs are highly questionable and until a ruling is made by the court, there is legally no majority either side. They already submitted their resignation (valid or otherwise). In such a precarious situation the swearing-in of new MB and Exco may not be legitimate as the current administration is still legally constituted and functioning.
