Sivakumar (left) and Ganesan IPOH, 17 June 2009: The High Court here has fixed 17 July to hear the suit by former Perak State Legislative Assembly Speaker V Sivakumar against the Barisan Nasional (BN)’s Speaker Datuk R Ganesan.
Sivakumar’s lead counsel Chan Kok Keong told reporters at the courthouse today that the case was mentioned before Justice Datuk Azhar Mohamed in chambers.
He said the court would hear on 17 July Ganesan’s application to strike out the suit, as well as an order for Sivakumar to pay RM100,000 as security for costs expected to be filed by the defendant’s lawyers headed by Datuk Hafarizam Harun.
Sivakumar filed the suit through Messrs Chan & Associates at the High Court Registry on 15 May after he was ousted during the chaotic Perak assembly sitting on 7 May. He is seeking damages for the alleged assault, battery and false imprisonment, and several injunctions including to prevent Ganesan from stopping him from exercising his duties as the legitimate speaker.
In the statement of claim, Sivakumar said he was still the assemblyperson for Tronoh and rightful Perak speaker, and that Ganesan’s presence in any sitting was in contempt of the assembly since he was not a member elected as an assemblyperson. — Bernama
