KUALA LUMPUR, 18 Feb 2009: The High Court today fixed 24 Feb for mention to consider three issues that cropped up on the first day of the legal battle over the appointment of the Perak Menteri Besar (MB).
The suit was initiated by Datuk Seri Mohammad Nizar Jamaluddin, who is challenging Datuk Dr Zambry Abdul Kadir’s appointment as MB.
The three issues are: whether Judicial Commissioner Mohamad Ariff Md Yusof should recuse himself from hearing the suit; whether the case should be referred to the Federal Court for determination of questions of law; and the standing of Perak state legal advisor Datuk Ahmad Kamal Md Shahid to represent Zambry in the suit.
Mohamad Ariff fixed the date after senior federal counsel See Mee Chun informed the court that she needed to take instructions on the Attorney-General Chambers’ stand on the three issues.
The case was fixed for mention today after Mohammad Nizar filed the suit on 13 Feb.
Present in court was Mohammad Nizar, represented by a team of eight lawyers led by Sulaiman Abdullah. Zambry was represented by Ahmad Kamal while See appeared for the Attorney-General’s Chambers and Datuk Mohd Hafarizam Harun is counsel holding a watching brief for Umno.
Mohammad Nizar is seeking a judicial review to declare him as the legitimate Menteri Besar and for an injunction to stop Zambry or his agents from carrying out the duties and functions of the Menteri Besar. — Bernama
